Former police chief gets jail time on drug charge

Former Chilhowie Police Chief Dwayne Sheffield was sentenced May 1 in Washington County Circuit Court to one year in jail on a charge of distributing methamphetamine.
Under a plea agreement, a second distribution charge, two charges of child abuse or neglect, and a charge of conspiracy to distribute were not prosecuted, court papers showed.
Judge Birg E. Sergent suspended 11 years and six months of the sentence, leaving one year to run concurrent with a sentence imposed in Smyth County Circuit Court, documents showed.
Upon release Sheffield will serve five years of supervised probation on the charge. “As a special condition of probation, the defendant shall pick up trash and litter in a designated area of Washington County as assigned by his/her probation officer and/or the litter control officer,” court papers said.
In early November in Smyth County, Sheffield took an Alford plea to a charge of object sexual penetration in a deal to avoid prosecution on four other related charges that stemmed from a haunted house sponsored by the Chilhowie Police Department.
Under an Alford plea, a defendant maintains he is innocent while admitting the prosecution has evidence sufficient for a conviction.
Judge William N. Alexander II sentenced Sheffield to 10 years’ imprisonment with six years and 10 months suspended. That left three years and two months with credit for time served since his arrest in May 2007, including house arrest.
After his sentence is complete, Sheffield is also to have no contact with the victim or her family and is required to register as a sex offender.
The plea allowed Sheffield to avoid prosecution on charges of rape, contributing to the delinquency of a minor, sexual battery and child endangerment.

If this had been someone other than an official do you think they would have gotten a slap on the wrist. It seems that some are above the law and free to do as they please while others have to answer for there crimes even tho we all know this creep in the end will get whats coming to him this article only goes to show how our justice system fails us. I hope that some higher ups in the government read this and take some action against this judge and the D.A that prosecuted this case. I’m ashamed to live in this country with these kind of people running it. I would hope when it comes time to vote again for this idiot who calls himself a judge that no-one would vote for him I believe the federal government needs to get off their asses and do their jobs and take this man off the bench and any other like him. This is not the only case here there have been others. But tell me what can we do to stop such travesties from happening again? I cant tell you the answer because its us against the government. But how long will this government last before we as the people begin to realise that they are not for us but against us? Open your eyes my friends and see that if your not in their little circle you are nothing to them but pawns in their games. How much longer do you want to be controlled by these people?

  1. the rest of us don`t get breaks,we get screwed…the whole system is so screwed up…We are the working poor barely getting by and still cant get health insurance for the kids..we make one dollar too much,,Apparently i am also the wrong skin color..we pay taxes and get nothing…the ones who dont work are usually illegals and they get everything handed to them..maybe my hubby should quit his job and stay on his butt allday..Glad that you are somewhat back…

  2. Yes Nyte it is outrageous, democracy is failing us. I write very critically in respect to politics, I am trying to slap this American public in the head and wake them up. Make this your formost efort Nyte, we have to get as loud a drum beat going as possible. And I’m sure you’ll agree, Euro Yank is the leader of the band, thank god for corageous people like him.

Nice to see you here again… you are shore ’nuff right… here in Deeeeetroit, our Mayor is up to his neck in illegal activities and is facing some serious multiple charges, but, he will sure ’nuff get minimal time, IF any… it is predicted that he will not suffer much at all… yep, it is infuriating and craziness… such a state of the un-Union we exist in…

  5. You’re right in concluding that this incident (and any others like it) are WRONG and should NOT happen in America (or anywhere else in the world). But as long as there are bad people alive, bad things will continue to happen in the world – it’s a given. With regard to this judge being removed from office, it would depend upon whether his judicial position was that of an elected or appointed official. If appointed, then his superior would be responsible for his removal. If elected, then public outcry (petition for removal from office, etc.) could apply pressure upon governmental bodies responsible for his removal from his “throne”. Either way, the American Bar Association does monitor and oversee issues such as these. So, be proactive in what happens in your region. Write to the Bar Association. Write to your governors, senators; write to the legislature. Let your voice be heard – your opinions be made known in the appropriate forum that can bring about change for the better.

    Though these bad things do occur from time-to-time (and as I said, should NOT), they are by far the minority when one considers the vast amount of cases heard, and judges overseeing those cases in the US. There are “bad eggs” in every bunch. There are always a certain few who “spoil” all the good things that are being done / have been done by honest, hard-working, upright citizens who are conscientious and working to make changes for the better in the US – like myself. Despite that (and I do NOT excuse their behavior by any means), I will continue to hope the best, believe the best, strive for the best, for the US. Nobody ever said it would be easy – and yes, there are a LOT of things wrong with this country – but I still hope for the best – believe for the best – and will do my civic duty to insure the best for all the generations that follow. There ARE still good people here who care, and as long as there are a few, there is hope. There is a chance.

    Ty guys for your comments i know im not on much anymore i was just a bit discourged and another reason is im outside more now that spring is here ive been planting rose bushes and flowers in my flower beds and keeping my lawn looking good im trying to do my part to beautify my part of the earth i know its not much but its the best i can do i hope you all have a great weekend and god bless you all
